Haq Mehar

Haq Mehar

Irshad khudawandi hai:
Auraton ke mehar khush dili ke sath (farz jante huye) ada karo albattah agar wohh khud apni khushi se mehar ka koi hissah tumhain muaaf kar dain to isey tum maze se kha sakte ho.

Mehar is raqam ya maal ko kehte hain jo haq zojiyat par dia jata hai yeh koi mutaiyan raqam nahi hai balkeh mard ki istetayat ke lehaz se jo nikah ke waqt tai ho jaye woh ada karni parti hai.

Hazrat Umer® aur Qazi sharih ka faislah yeh hai keh agar aurat ne apne shohar ko pura mehar ya is ka koi hissah muaaf kar dia ho aur baad mein wohh phir is ka mutalbah karne lage to shohar is ke ada karne par majbur ho jaye ga kiun keh is ka mutalbah karna yeh maine rakhta hai keh woh apni khushi se mehar ya is ka koi hissah nahi chorna chahti.

Aurat ki muashi haisyat aur mustahkam ho jati hai jab Quran ka yeh hokum samne aata hai.

agar tum ne auraton ko buhat sa maal bhi dia to is mein se kuch bhi tum wapis na lo.

Quran is baat par israar karta hai keh mard aurat se tamta uthane se pehle is ka haq mehar ada kar dain. Woh auratain jo halal hain yani jin se nikah karne jaiz hai un ke bare mein kaha gia

Isi tarah sura Al-Maidah mein irshad hota hai:
aur mahfuz auratain bhi tumhare liye halal hain khuwa woh ahle imaan ke goroh se hon ya in qomon mein se jin ko tum se pehle kitab(book) di gayi thi basharte keh tum in ke mehar ada kar ke nikah mein in ke muhafiz bano na yeh keh aazad shewat rani karne lago ya chori chuppe aashnaiyan karo aur jis kisi ne imaan ki roshni par chalne se inkar kia to is ka sara karnama zindagi zaya ho jaye ga aur aakhrat mein diwalyah hoga.

Haq mehar ada karne ke liye Quran Kareem musalman mardon ko yun tanbih karta hai.

Surah nisa ki 19 aayat mein irshad hota hai:
Aye logo! Jo imaan laye ho tumhare liye yeh halal nahi hai keh zabardasti auraton ke waris ban baitho aur na yeh keh halal hai keh unhain tang kar ke is mehar ka kuch hissah ura lene ki koshish karo tum unhain de chuke ho han agar woh sirf bad chalni ki murtakab hon (to tumhain bator saza zarur unhain tang karne ka haq hai).

Jin shadi shuda logon ke mehar istetaut se ziadah likhe huye hain in mein islah ki yahi surat hai keh who khush aslubi aur nek niyati se apni biwiyon ko mehar kam kar dene par raza mand karein aur biwiyon ko chahiye keh woh deen-o-dunya donon ki maslehat ko pesh nazar rakh kar apne mehar kam kar dene par razi ho jayain aur is qadar kam dar dain keh in ke shohar aasani ke sath ada kar sakain is tarah donon aaram aur sakun se zindagi basar karain ge aur mard bahar haal is ahsaas par apni biwiyon ke sath pehle se bhi ziadah khush rahain ge. Yahan yeh baat zehan nasheen rahe keh mehar aik tarah ka qarz hai aur qarz ko allah taala akhrat mein har giz nahi bakhshe ga.

Hazrat Muhammad (SWA) ne farmaya:
Jis ne aik maal mehar ke ewaz kisi aurat se nikah kia aur niyat yeh rakhi keh who is mehar ko ada nahi kare ga who dar asal zani hai aur jis ne qarz lia aur niyat yeh rakhi keh who is ko ada nahi kare ga who dar asal chor hai.


Mehar ki muafi sirf aurat ke ikhtiyar mein hai.

Surah Baqrah mein irshad hota hai.

Magar yeh keh auratain narmi bartein.

Mehar chun keh aurat ka haq hai is liye yeh isi waqt muaaf ho sakta hai jab aurat khud muaaf kar de.

Quran ke yeh alfaz:

(Agar auratain dil ki khusnudi se kuch hissah muaf kar dein.) batate hain keh is mein aurat ki khusnudi ka pura pura lehaz karna hoga. Ghar ki fiza ko aisa na banaya jaye keh kisi dabao aur lalach se majbur ho kar aurat mehar muaaf kar de aur dar haqiqat who mehar chorne ke liye na ho.
Mehar muqar’rar na kia to kuch de kar rukhsat karna zaruri hai.

Irshad bari taala hai:

Agar tum auraton ko in ke pas jane aur in ka mehar muqar’rar karne se pehle talaq de do to tum par koi gunah nahi. Han is surat mein unhain kuch na kuch zarur do. Khush hal aadmi apne maqdur ke mutabiq aur ghareeb aadmi apni haisyat ke mutabiq maruf tareeqe par de.

Yeh hokum is aurat ka hai jis ko shohar ne hath na laga ya ho rahi who aurat jis se shohar ne talluq zan shohar qaaim kar lia ho to is aurat ko is ke khandan ki dusri is jaisi larkiun ke barabar mehar dia jaye ga.
